 By accessing or using Aurum Fashion in services, including but not limited to providing luxury garments & designer products, you agree to be bound by the terms and conditions outlined in this Terms of Service Agreement, If you do not agree to these terms, you may not avail of our services.

Acceptance of terms
These Terms shall be deemed effective immediately upon your access or use of our services.

Use of the Website is Allowed only to people who are able to form & enter legally binding contracts under Indian laws. All people who are deemed "incompetent to contract" within the meaning of the Indian Contract Act, of 1872 cannot use the Website. As an example, someone below the age of 18 or an undischarged insolvent is prohibited from using this website or from forming or entering any contract with Aurum. We also do not allow access to people whose Membership has been terminated or suspended by Us for any reason. Unless additional terms and conditions are provided which are product specific, these Terms trump all previous understandings arrangements representations, or agreements. • Customization:

Please note that all custom-made orders are non-refundable, non-exchangeable, and non-returnable. Any alterations made to an item will be considered customization according to these terms. Generally, the basic silhouette of a product cannot be changed. However, customization will be accepted for specific modifications such as adding a plain sleeve, covering a sheer part, altering measurements, or changing the color. Embroidery requests will also be considered as customization and will be subject to additional charges.

 Orders for products in size XS and below, as well as size XXL and above, will be treated as custom-made. Additionally, any early delivery order will also be considered custom made. Please note that all customization requests are subject to availability and confirmation.

 If the designer undertakes any customizations, there may be associated charges. You will be informed about the customization charges, if applicable, after sharing the customization details. This process may take 3-4 working days and could occur after the initial/full payment for the order has been processed. We reserve the right to cancel or withdraw the offer for customization at any time without prior notification.

 When it comes to custom-tailored outfits, it usually takes an average of 2 trials to ensure the right fit. We recommend considering these trials when assessing the timelines that work for you.

 Please be aware that color customizations may result in a slight difference in the final result due to the hand dyeing process. The final color may vary slightly, appearing darker, lighter, or slightly different from the original.

 If any fitting issues arise due to erroneous alterations or production, we will rectify the issue. However, if the product has been altered/customized based on the provided measurements, we do not take responsibility for subsequent fitting issues. If additional alterations are needed, they can be done at an additional cost, subject to the availability of resources on our end. Please note that some repairs/alterations may be chargeable.

 Complimentary alteration service is available for non-discounted products within one month of delivery for orders delivered in India. This service is limited to basic alterations. Alteration requests made after one month of the delivery date will incur charges.

 All alterations for discounted merchandise will be chargeable, regardless of the purchase date, product value, or type of alteration. We will inform you of the alteration charges after examining the product and reviewing the alteration details. This process may take 3-4 working days and could occur after the initial/full payment for the order has been processed.

 

• Waiver

If there is a breach of the Terms or any policy by you and we do not take immediate action, it does not waive our right to enforce our rights and remedies in any other instance where you breach the Terms or any policy. Our entitlement to use our rights and remedies will remain applicable and enforceable in such situations.

 

• Intellectual Property Rights:

The Company will not be held liable for any intellectual property infringements discovered in any product listed on the Site unless such product is manufactured by a brand owned by the Company.

 

• Force Majeure:-

In the event of unforeseen circumstances or events beyond our reasonable control, including but not limited to storms, tsunamis, fires, floods, earthquakes, outbreaks of contagious diseases, acts of God, governmental actions, industrial disputes, strikes, labor unrest, civil commotion, riots, terrorist attacks, war, adverse environmental or weather conditions, mechanical breakdowns, obstruction of public or private roads/highways, etc., we shall not be held responsible for any loss or failure to fulfill our obligations under these Terms.

 

• Indemnity

You are responsible for indemnifying and holding Aurum, its subsidiaries, associates, consultants, contracted parties, and their respective officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorney's fees, made by any third party or any penalties imposed as a result of your breach of these Terms or any policy/document incorporated by reference, or your violation of any laws, rules, regulations, or the rights of a third party.

 

• Release

By accepting these terms, you explicitly release Aurum, its associates, officers, and representatives from any costs, damages, liabilities, or other consequences resulting from the actions or inactions of Aurum's suppliers, fashion designers, vendors, courier companies, or any other involved parties. Furthermore, you waive any claims or demands you may have against Aurum in connection with such matters, whether arising under statute, contract, or any other legal basis.

 

• Governing law & jurisdiction

The Terms and any policy shall be governed by and interpreted in accordance with the laws of the Republic of India. Any dispute or disagreement arising from the interpretation or otherwise relating to any conditions of the Terms shall be referred exclusively to the courts in Raipur, which shall have jurisdiction over such matters.

 

• Intellectual Properties

Aurum acknowledges that the information on its website may also include content provided by its suppliers, fashion designers, vendors, or other relevant parties whose merchandise Aurum showcases. While Aurum endeavors to verify the information received from these sources before publishing it on the website, there may be occasions where such information is presented without further verification. Consequently, if any material is found to be incorrect, false, objectionable, or in violation of intellectual property rights, the responsibility lies with the suppliers, vendors, fashion designers, etc. who provide Aurum with the information and merchandise.

 

• Notice

Any notice to Aurum under this Agreement may be delivered by prepaid post to the following address Opposite Mandi Gate, Main Road, Pandri, Raipur, Chhattisgarh, India

 You will be required to provide a valid phone number while placing an order on  us. Aurum may communicate with you either by email, short message services (SMS), phone calls, or by posting notices on the Website or by any other mode of communication to fulfil your Order. Thus, for contractual purposes, you consent to receive communications including SMS, email, or phone calls from us with respect to your Order or any offers or promotions.

 

• Your Obligation

You agree to respect all intellectual property rights notices, information, and restrictions associated with the products or the content on the Aurum website.

 Any products purchased from Aurum, its affiliates, or contractors should be used for lawful purposes in compliance with all applicable Indian laws.

 You are responsible for monitoring and restricting minors' use of the internet, including their access to the Aurum website. You accept full responsibility for any unauthorized use of the website by minors, including the use of your credit cards, debit cards, or other payment instruments to place orders on the website. Please note that a minor refers to a person who is under 18 years of age.

 

• You agree not to engage in the following actions directly or indirectly:

 - Violate any applicable Indian laws or the terms set forth in these Terms while using the website or making any purchases.

- Access the website using a false identity or on behalf of someone other than yourself.

- Use Aurum's website or its products for non-personal or commercial purposes. For example, using website content for advertisements, solicitation, or gathering and reselling products purchased from the website.

- Portray Aurum or its products in an offensive, hateful, defamatory, inaccurate, or false manner.

- Take actions that harm the goodwill or reputation of Aurum, its associates, contractors, suppliers, designers, etc.

- Attempt to gain unauthorized access to the website, interfere with the use or enjoyment of the website by others, or disrupt the operation of the website.

- Create or submit any unlawful, offensive, obscene, defamatory, libelous, threatening, discriminatory, harassing, bullying, vulgar, indecent, profane, hateful, racially, culturally, or ethnically offensive submissions that encourage criminal conduct or violate applicable Indian laws.

- Send spam, chain letters, pyramid schemes, or any other unsolicited or unauthorized advertising or promotional materials on behalf of Aurum to anyone, including existing customers/designers or users of the website.

- Harass, bully, stalk, harm, defame, disparage, or engage in any other unlawful or objectionable conduct while using the website or making purchases.

- Collect, obtain, compile, gather, transmit, reproduce, delete, revise, view, display, or forward any material, data, or information (personally identifiable or not) posted by or concerning other users of the website.

- Violate any intellectual property rights or proprietary rights of Aurum, its licensors, associates, contracted parties, or any third party while using the website or making purchases.

Various factors can lead to order cancellation, including limited quantities available for purchase, unavailability of Cash on Delivery (COD) option in your area (if selected), inaccuracies or errors in product or pricing information, or any defects in the product. Additionally, we may request additional verification or information before approving an order. In the event that your order or a portion of it is canceled, or if further information is needed, we will contact you accordingly. If your payment has already been processed and the order is subsequently canceled, the amount paid will be reimbursed to your account within 5 to 7 working days of providing us with your bank account details for the refund. Please note that cash refunds will not be issued under any circumstances. If you have made an online payment and we are unable to refund the amount within the specified timeframe, you may consider initiating a chargeback.

 

• User-initiated Order Cancellations:

For requests to cancel orders, we hold the right to accept or reject such requests at our discretion. As part of our standard business practice, if a cancellation notice is received within 24 hours of placing the order, we will cancel the order and refund the full amount. Once your order is successfully canceled, the amount paid by you will be refunded to your account within 5 to 7 working days after we receive your bank account details for the refund process. Please note that we are unable to process cash refunds under any circumstances. Orders that have already been processed (including those processed within the first 24 hours) or cancellation requests received after the 24-hour window expires cannot be canceled. We hold the sole discretion to determine whether an order has been processed or not, and you agree not to dispute our decision in this regard. It is important to clarify that beyond the initial 24-hour period, you will not be eligible to cancel an order and receive a refund.

Regarding online payments, you may initiate a chargeback only if you are eligible for canceling your order as per the terms outlined here, and please note that these terms are subject to change and it is recommended to review them periodically for any updates.
